## Cookies and Tracking Technologies

Our Website uses cookies and similar technologies to function correctly and to help us understand how visitors use the site.

**Strictly necessary cookies** make the site work — for example, by remembering your form entries during a session. These cannot be turned off.

**Analytics cookies** help us understand which pages are most useful, how visitors navigate the site, and where we can improve. We use Google Analytics 4 for this purpose. **Advertising cookies** — At launch, our Website does not use advertising cookies on pages where patients submit forms or other PHI. If we add advertising cookies in the future, we will update this Policy and provide an opt-out mechanism.

**Tracking on patient-facing pages.** Following the December 2022 guidance from the U.S. Department of Health and Human Services Office for Civil Rights regarding online tracking technologies, **we do not use third-party advertising or social-media tracking technologies on pages where you provide health information or fill out patient forms.** Our analytics on those pages is limited to first-party server-side measurement.

You can manage cookies through your browser settings. Blocking some cookies may affect how the Website functions.

## How We Share Your Information

We may share your information in the following circumstances:

## Service Providers

We use third-party service providers to operate the Website and provide services on our behalf. Current service providers include:

- **Pantheon** — website hosting (Pantheon is HIPAA-compliant and has a Business Associate Agreement with Arbor)
- **Google Analytics 4** — website analytics (configured with IP anonymization and no advertising features enabled on PHI-collecting pages)
- **RingCentral** — call tracking and phone system (HIPAA-compliant configuration; we do not transmit call recordings to advertising platforms)
- **Mailchimp** — newsletter delivery (only used for marketing communications you have opted into; no PHI is transmitted)
- **Mailgun** — transactional email (HIPAA-compliant configuration with a Business Associate Agreement)

These service providers are contractually obligated to use your information only for the purposes for which we engaged them and to safeguard your information consistent with applicable law.

## Business Associates Under HIPAA

We may share your PHI with HIPAA business associates who perform services for us, as described in our [Notice of Privacy Practices](/hipaa-notice-of-privacy-practices). All business associates are required by written contract to safeguard your PHI in accordance with HIPAA.

## Legal Obligations

We may disclose your information when we believe in good faith that disclosure is required by law, by court order, or by governmental regulation, or to protect the rights, property, or safety of Arbor, our patients, or others.

## With Your Consent

We may share your information with other parties when you have given us your consent to do so.

## Reproductive Health Information

Consistent with our values and the commitments described in our Notice of Privacy Practices, **we will not voluntarily share information about your reproductive healthcare with law enforcement, prosecutors, or other third parties for the purpose of investigating or prosecuting any person for seeking, receiving, or providing lawful reproductive healthcare.** Where legally permissible, we will require a court order or judicial subpoena before disclosing reproductive health information.

## What We Do Not Do

- **We do not sell your personal information.** Federal law (HIPAA, as amended by HITECH) prohibits the sale of PHI without your specific written authorization, and Arbor does not sell personal information of any kind.
- **We do not share your personal information for cross-context behavioral advertising** (sometimes called "targeted advertising") on pages where you provide health information.
- **We do not transmit your medical information to third-party advertising platforms** such as Meta Pixel, Google Ads conversion pixels, or TikTok Pixel.

## Your State Privacy Rights

Depending on the state you live in, you may have certain rights regarding the personal information we collect about you. These rights may include:

- The right to **know** what personal information we have collected about you and how we use and share it
- The right to **access** a copy of the personal information we hold about you
- The right to **correct** inaccurate personal information
- The right to **delete** your personal information, subject to certain exceptions
- The right to **opt out of the sale or sharing** of your personal information (we do not sell or share for cross-context behavioral advertising)
- The right to **opt out of targeted advertising** (we do not use targeted advertising on PHI pages)
- The right to **data portability** — receive your personal information in a machine-readable format
- The right to **non-discrimination** for exercising these rights

These rights apply to residents of California (under CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), Oregon (OCPA), and certain other states with comprehensive privacy laws. We will honor your rights regardless of where you live, to the maximum extent practicable.

**To exercise any of these rights**, please contact us using the information at the bottom of this Policy. We will respond within 45 days, with one possible 45-day extension if more time is needed and we notify you.

We will not retaliate against you for exercising any of these rights.

## Washington Residents — My Health My Data Act

If you are a resident of Washington State, you have additional rights under the **Washington My Health My Data Act (MHMDA)** regarding "consumer health data," which is broadly defined to include reproductive health information. We do not share consumer health data with third parties for purposes other than providing the services you have requested or as required by law. To exercise your MHMDA rights, contact us using the information at the bottom of this Policy.

## California Privacy Rights — Additional Disclosures

Under the California Consumer Privacy Act (CCPA) and CPRA amendments, California residents may also request:

- The **categories** of personal information we have collected about them in the past 12 months
- The **categories of sources** from which we collected that information
- The **business purposes** for collecting or sharing that information
- The **categories of third parties** with whom we share that information

We have not sold California residents' personal information in the preceding 12 months and do not anticipate doing so.

## Children Under 18

The Website is not directed to children under 18. We do not knowingly collect personal information from individuals under 18. If you are under 18, please do not submit any information to us through the Website. If we learn that we have collected personal information from a child under 18, we will delete it.

Note: Some fertility care services involve the storage of reproductive material on behalf of minors for medical reasons (for example, fertility preservation before cancer treatment). This is handled directly through our clinical team, not through Website forms, and is subject to parental consent.

## Data Security

We implement reasonable administrative, physical, and technical safeguards to protect your information, including:

- Encryption of data in transit (TLS 1.2 or higher) and at rest where supported by our service providers
- Access controls that limit who at Arbor can view your information based on job role
- Regular security reviews and updates of our Website and patient-facing systems
- Business Associate Agreements with all vendors that handle PHI
- Staff training on privacy and security obligations
- Documented incident response procedures

No security measure is perfect, and we cannot guarantee the security of any information you transmit to us over the internet. If we become aware of a security incident affecting your information, we will notify you in accordance with applicable law.

## Data Retention

We retain personal information for as long as necessary to provide you with services and to comply with our legal obligations. Medical records are retained in accordance with **Missouri medical record retention requirements** (which generally require retention for at least 7 years after the patient's last visit, longer for minors).
